Scope

The shop offers sound carriers (e.g. vinyl records) and digital music files by Edition Hawara and Hawara International. The terms apply to consumers and entrepreneurs; for consumers, mandatory statutory provisions remain unaffected. Deviating terms of the customer do not apply unless we expressly agree in writing.

Conclusion of contract

The presentation of products in the shop is not a binding offer but an invitation to order. By clicking the button “Order with obligation to pay” you submit a binding offer to purchase the goods in your cart. Before sending the order you can check and correct your entries. We confirm receipt of your order by email (order confirmation); this is not yet acceptance. The contract is concluded when we ship the goods or send you the download link, or when we expressly accept the order. The order details are sent to you by email. Pre-orders are binding for both sides; the expected release date is stated on the product page.

Prices and payment

All prices are in euros and include statutory value added tax. Shipping costs are not included in the product price; they depend on the destination, are shown in the cart and at checkout before you place the order, and are added to the total. Payment is made via PayPal (including card payment through PayPal) or other methods offered at checkout. Payment is due on conclusion of the contract. For pre-orders, payment may be taken at the time of ordering.

Shipping outside the EU. Orders delivered to countries outside the EU are exempt from Austrian VAT. Prices shown include 20 % VAT; the VAT is removed automatically at checkout once you enter your delivery address. Import duties, customs fees or local taxes of your country are not included and may be charged on delivery.

Delivery

We ship worldwide as far as the destination is offered at checkout. Delivery is by postal or parcel service; the cost per destination is shown at checkout. Collection in Vienna is possible by arrangement if “Local pickup” is offered at checkout. Delivery times stated are estimates; unless otherwise agreed we ship within a reasonable time after receipt of payment for items in stock. Pre-ordered items are shipped after release. For deliveries outside the EU, import duties, taxes and customs fees of the destination country are borne by the customer. If an item is not available, we will inform you promptly and refund any payment made.

United Kingdom. We currently cannot ship to the United Kingdom from this shop. We kindly ask you to order via our Bandcamp Page. Thank you for your understanding!

Digital products are made available as a download after payment, on the order confirmation page and by email. Please store the files; download links may expire after a certain period or number of downloads.

Retention of title

The goods remain our property until full payment. This applies to entrepreneurs; for consumers the statutory rules apply.

Right of withdrawal and returns

Consumers have a 14-day right of withdrawal as set out in our Return Policy, which includes the model withdrawal form. Return shipping costs are borne by the buyer. The right of withdrawal does not apply to digital content once the download has been made available with your express consent.

Statutory warranty

The statutory warranty rights (Gewährleistung) apply. For consumers, the warranty period for new goods is two years from delivery. Please report defects to shop@editionhawara.com. We will repair or replace the item or, if that is not possible, reduce the price or refund. Costs of returns in warranty cases are borne by us. Minor surface noise or pressing characteristics typical of vinyl that do not affect playback, and sound differences between reproduction systems, are not defects. For entrepreneurs the warranty period is 12 months; § 377 UGB (duty to inspect and notify) applies.

Liability

We are liable for damages caused intentionally or by gross negligence without limitation. For slight negligence we are liable only for personal injury and, towards consumers, to the extent required by mandatory law; towards entrepreneurs liability for slight negligence is excluded, as is liability for lost profit. Claims under the Product Liability Act remain unaffected.

Intellectual property

All content on the site (texts, images, audio, artwork) is protected by copyright and related rights and may not be copied or used commercially without permission. The purchase of music, whether physical or digital, is for private use only and does not include the right to publish, share or sell the recordings.

Applicable law, jurisdiction, dispute resolution

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only so far as it does not deprive them of mandatory consumer protection provisions of the country where they have their habitual residence. For entrepreneurs the place of jurisdiction is Vienna. Consumers can sue us at their place of residence or work in the EU, to the extent mandatory law gives them that right.

The EU online dispute resolution platform has been discontinued. We are not obliged to take part in out-of-court dispute resolution proceedings. Consumers are welcome to contact us first at shop@editionhawara.com; we will try to find a solution.

Final provisions

The contract language is English. Should individual provisions be invalid, the remaining provisions remain valid. These terms were last updated on 3 October 2026.
