Right of withdrawal (consumers)

If you are a consumer (you buy for purposes outside your trade or profession), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. If you ordered several goods in one order that are delivered separately, the period runs from receipt of the last item. For pre-orders, the period starts when the goods are delivered to you.

To exercise the right of withdrawal you must inform us (Edition Hawara OG, Bernardgasse 16/13, 1070 Vienna, Austria, shop@editionhawara.com) by a clear statement (e.g. an email or a letter) of your decision to withdraw. You may use the model form below, but you do not have to. It is sufficient to send your notice before the period has expired.

Returning the goods

Please send the goods back to us without undue delay and in any event within 14 days from the day you informed us of the withdrawal, to:

• You bear the direct costs of returning the goods (return postage). We do not provide a prepaid return label.
• Please pack records carefully (stiff mailer, protected sleeve) and use a tracked and insured service. You bear the risk of the goods during return transport.
• Parcels sent “freight collect” or without sufficient postage cannot be accepted.
• Please include your order number and name.

Refund

If you withdraw, we will reimburse all payments received from you, including the costs of standard delivery (but not the additional costs if you chose a delivery type other than the least expensive standard delivery we offer), without undue delay and within 14 days of the day we receive your withdrawal notice. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier. We refund using the same payment method you used for the original transaction, free of charge to you.

You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (e.g. played, scratched or damaged records, missing sleeves or inserts). In that case we may deduct the loss in value from the refund.

Digital products (downloads)

For digital content that is not supplied on a tangible medium (e.g. WAV/MP3 downloads), the right of withdrawal expires as soon as we have begun the performance – i.e. when the download is made available – if you have expressly agreed to this and acknowledged that you thereby lose your right of withdrawal (§ 18(1)(11) Austrian Distance and Off-Premises Contracts Act, FAGG). We ask for this confirmation in the checkout before you place an order that contains digital products. For combined products (vinyl + digital), the right of withdrawal for the physical item remains unaffected, but the digital part cannot be returned once it has been made available.

Defective or damaged items

If an item arrives damaged, defective or is not the item you ordered, please contact us at shop@editionhawara.com within a reasonable time with your order number and, if possible, photos. In these cases the statutory warranty (see our Terms & Conditions) applies and we bear the return costs; we will repair, replace or refund. Please do not send the item back before we have agreed on this.

Exceptions

There is no right of withdrawal for goods made to your specifications or clearly personalised, and for sealed audio or video recordings if the seal has been removed after delivery, as far as this is permitted by law. Business customers (entrepreneurs) have no statutory right of withdrawal; returns only by agreement, with return costs borne by the customer.
